CONSCIOUSLY LIVING™, LLC
UNIVERSAL TERMS AND CONDITIONS

These Terms and Conditions (“Agreement”) govern your participation in, purchase of, and access to any products, services, experiences, events, digital content, or educational programs offered by Consciously Living™, LLC (“Company,” “We,” “Us,” or “Our”), owned and managed by Leah Smith. This Agreement applies across all brand experiences operated under Consciously Living™, LLC, including but not limited to:

The Slumber Party Series™ and Slumber Party Box™

Faith & Facials™
-
Fika Skön™ — skincare boutique (currently inactive; reserved for future offerings including private label products)

The Face Yoga Institute™, including all instructor training, certification programs, and curricula
-
Corporate Wellness programs and partnerships
-
Speaking engagements and keynote presentations by Leah Smith on behalf of Consciously Living™, LLC
-
Live commerce activities including but not limited to WhatNot, TikTok Shop, and similar platforms
-
Any future brands, experiences, or offerings developed under Consciously Living™, LLC
By purchasing, registering, attending, or participating in any offering associated with Consciously Living™, LLC, you (“You,” “User,” “Participant,” or “Customer”) agree to be bound by the terms set forth in this Agreement.
1. Corporate Structure
All brands and trade names listed above operate as DBAs (doing business as) under Consciously Living™, LLC, a Louisiana limited liability company. All legal obligations, liabilities, insurance coverage, and contractual relationships flow through Consciously Living™, LLC. Invoices and payment confirmations issued under any brand name constitute transactions with Consciously Living™, LLC.
Fika Skön™ is a trade name held by Consciously Living™, LLC. Though currently inactive as a service offering, it is retained for potential future use, including private label product development. Any future activation of this brand will be governed by this Agreement.
2. Nature of Offerings
The programs, products, and experiences offered by Consciously Living™, LLC span the following categories:
Experiential Events & Boxes
The Slumber Party Series™, Faith & Facials™, and related curated box offerings are experiential programs designed to foster wellness, mindfulness, and community connection. These may include skincare, relaxation techniques, journaling, spiritual reflection, guided discussion, and light movement.
Corporate Wellness
Corporate wellness sessions are educational and engagement-focused programs offered to organizations and schools. All content is advisory and educational in nature. Nothing presented in a corporate wellness context constitutes medical, therapeutic, legal, or financial advice.
Speaking Engagements
Leah Smith is available for keynote presentations, panels, workshops, and speaking engagements under the Consciously Living™, LLC umbrella. All speaking content is educational and inspirational in nature and does not constitute professional medical, legal, financial, or therapeutic advice. Booking terms for speaking engagements are outlined in a separate speaker agreement and are incorporated by reference into this Agreement.
Live Commerce (WhatNot, TikTok Shop & Similar Platforms)
Purchases made through live sales events on platforms such as WhatNot, TikTok Shop, or similar channels are transactions with Consciously Living™, LLC. All sales are subject to this Agreement. Platform-specific policies may also apply, and the Company is not responsible for platform outages, errors, or third-party platform policies.
Instructor Training & Certification (Face Yoga Institute™)
The Face Yoga Institute™ offers instructor training programs based on an IPHM-approved curriculum developed by Leah Smith. Upon successful completion, participants receive a certificate authorizing them to teach the curriculum commercially. Certification does not confer a medical license, and certified instructors must not represent face yoga as a medical treatment or therapy.
All offerings are educational, experiential, and community-based in nature. Participation does not establish a medical, therapeutic, counseling, legal, or financial advisory relationship with the Company.
3. No Medical Claims — Important Disclaimer
PLEASE READ THIS SECTION CAREFULLY. Nothing offered by Consciously Living™, LLC — including but not limited to face yoga exercises, skincare routines, relaxation techniques, wellness coaching, spiritual discussions, speaking content, or any products contained in curated boxes — constitutes medical advice, diagnosis, treatment, or therapy.

Face yoga and facial exercises are movement-based educational practices. They are not medical treatments and are not intended to prevent, treat, cure, or diagnose any disease or medical condition.

Relaxation, breathwork, mindfulness, and wellness activities are for general well-being and personal development only.

Spiritual and reflective discussions are for community and personal growth, not psychological therapy or counseling.

Any coaching, business, or life guidance provided is educational and advisory only — not legal, financial, or clinical advice.

Speaking engagements and keynote presentations are educational and motivational in nature only.
You should always consult a licensed physician, dermatologist, or other qualified healthcare provider before beginning any new exercise program, skincare routine, or wellness practice, particularly if you have pre-existing health conditions, skin sensitivities, or concerns.
4. Product & Allergy Disclaimer
Curated boxes, experience kits, and any products sold or distributed under any Consciously Living™, LLC brand may contain skincare products, oils, masks, botanical extracts, essential oils, or other materials intended for external use only.
By using any product received through a Consciously Living™, LLC offering, You acknowledge and agree that:

You are solely responsible for knowing your own allergies, skin sensitivities, and health conditions before using any product.

You will read all ingredient labels carefully prior to use.

You will perform a patch test on a small area of skin before full application.

If you experience any adverse reaction — including but not limited to redness, swelling, itching, rash, burning, or irritation — you will immediately discontinue use of the product and consult a healthcare provider.

Products may contain natural ingredients, essential oils, botanical elements, or fragrances that may cause sensitivity or allergic reactions in some individuals.

The Company and its representatives are not liable for any allergic reactions, skin irritation, injuries, or sensitivities resulting from product use.
All products are provided “as is.” The Company disclaims any express or implied warranties regarding product suitability, effectiveness, or fitness for any particular purpose.
5. Eligibility
Participation in any Consciously Living™, LLC offering is intended for adults 18 years of age or older. Minors may participate only with documented written consent from a parent or legal guardian, who assumes full responsibility for the minor’s participation.
6. Intellectual Property
All content, curricula, materials, videos, names, logos, methodologies, and branded materials associated with Consciously Living™, LLC and its brands — including The Face Yoga Institute™ IPHM-approved curriculum — are the exclusive intellectual property of Consciously Living™, LLC.

You may not reproduce, distribute, publish, share, sublicense, or create derivative works from any Company materials without prior written permission.

Certified instructors through The Face Yoga Institute™ are licensed to teach the approved curriculum only. They may not modify, rebrand, or resell the curriculum itself, nor represent the materials as their own original work.

Unauthorized use of any intellectual property may result in revocation of certification and/or legal action.
7. Event Participation & Code of Conduct
By attending or participating in any in-person, virtual, or hybrid Consciously Living™, LLC event, You agree that:

Your participation is voluntary and undertaken at your own risk.

You are responsible for your own physical and emotional well-being throughout the session.
-
You will treat all participants, facilitators, and staff with respect and courtesy.

Harassing, discriminatory, threatening, or disruptive behavior of any kind will not be tolerated and may result in immediate removal without refund.

The Company reserves the right to remove any participant for disruptive, inappropriate, or unsafe behavior at any time, without refund.

You will not record, screenshot, livestream, or distribute any event content without prior written consent from the Company.

Events may be photographed or recorded by the Company for marketing purposes. Attendance constitutes consent to incidental appearance in such materials.
8. Payments, Refunds & Cancellations
The following policies apply across all Consciously Living™, LLC offerings:
General

All purchases, ticket sales, box orders, registrations, and program enrollments are final once payment is processed or fulfillment begins.

Refunds are only issued where required by applicable law.

Subscriptions and memberships renew automatically unless canceled prior to the next billing cycle. Partial-month refunds are not available.
Curated Boxes & Physical Products

Due to the customized and hygienic nature of curated boxes, no refunds or exchanges will be issued on physical product orders.

Report items damaged in transit within 7 business days of delivery with supporting photographic evidence for review.
Live Events & Corporate Wellness

Event tickets are non-refundable once purchased.
-
Tickets may be transferred to another attendee if a written transfer request is submitted at least 7 days prior to the event.

If an event is canceled by the Company, participants may receive a rescheduled date or account credit at the Company’s sole discretion.
Private Sessions & 1:1 Appointments

Cancellations must be made at least 24 hours in advance to reschedule without penalty.
-
Same-day cancellations and no-shows are non-refundable.
Certification Programs
-
Certification program fees are non-refundable once curriculum access or training materials have been provided.
9. Shipping & Fulfillment

Physical products are shipped via standard carriers.
-
The Company is not responsible for delays, damages, or losses caused by postal carriers, incorrect addresses provided by the customer, or missed deliveries.
-
Replacement requests for items damaged in transit must be submitted within 7 business days of delivery with supporting photographic evidence.
10. Instructor Certification — Face Yoga Institute™
The following additional terms apply to all participants in Face Yoga Institute™ instructor training programs:

Certification authorizes the graduate to teach the approved Face Yoga Institute™ curriculum in group or individual settings for compensation.

Certified instructors must not make medical claims in connection with face yoga instruction, advertising, or marketing.
-
Certified instructors must not represent themselves as medical professionals or imply that face yoga treats, cures, or prevents any medical condition.
-
The Company’s IPHM-approved curriculum may not be reproduced, redistributed, rebranded, or incorporated into other paid programs without written authorization.

Certification may be revoked at the Company’s discretion for violations of these terms or conduct that reflects negatively on the Consciously Living™ brand.
11. Privacy Policy
Consciously Living™, LLC is committed to protecting your personal information. This section governs how we collect, use, and protect data across all brand websites and platforms.
Information We Collect

Personal data including name, email address, mailing address, and payment details when you purchase or register for any offering.

Event participation information and communication preferences.

Basic website analytics and usage data.

Payment data is processed securely by third-party payment processors. The Company does not store full payment card details.
How We Use Your Information

To process transactions and fulfill orders.

To communicate updates, event information, and marketing emails (if you have opted in). You may unsubscribe at any time.

To improve our offerings and user experience.
Data Sharing & Security

We do not sell your personal data.

Information may be shared only with trusted service providers necessary to operate our business, or as required by law.

We use reasonable security measures to protect your data, but cannot guarantee absolute protection of information transmitted online.
Cookies & Analytics

Our websites may use cookies and analytics tools including Google Analytics and Meta Pixel.

You can disable cookies through your browser settings at any time.
Media & Testimonials

By participating in events or submitting testimonials, you grant the Company permission to use your likeness, voice, or written feedback for marketing purposes unless you request otherwise in writing.
Children’s Privacy

We do not knowingly collect personal data from individuals under 18 years of age without verified parental consent.
12. Limitation of Liability & Indemnification
To the fullest extent permitted by applicable law:

The Company, its owner, employees, contractors, affiliates, and representatives shall not be liable for any injuries, adverse reactions, losses, emotional distress, or damages of any kind arising from your participation in any offering or use of any product.

This limitation applies to all brands and experiences operating under Consciously Living™, LLC.

You agree to indemnify and hold harmless the Company and its affiliates from any claims, losses, liabilities, or expenses (including reasonable attorneys’ fees) arising from your actions, misuse of products, violation of this Agreement, or infringement of any third-party rights.
13. Technology & Virtual Access
Access to virtual events and digital content requires a reliable internet connection and a compatible device. The Company is not responsible for participant-side connectivity issues, login errors, platform outages, or technical failures beyond its control.
14. Affiliate Links & Third Parties
The Company may share affiliate links or collaborate with third-party brands aligned with its values. These partnerships are disclosed for transparency. The Company is not liable for the actions, quality, accuracy, or content of any third-party products or services.
15. Force Majeure
The Company shall not be liable for cancellations, delays, or service interruptions caused by circumstances beyond its reasonable control, including illness, natural disasters, technical failures, platform outages, governmental orders, or other unforeseeable events. In such cases, a credit or rescheduled offering may be provided at the Company’s discretion.
16. Modifications to These Terms
The Company reserves the right to update or modify this Agreement at any time. Updated versions will be posted on the Company’s official website(s) and linked platforms. Continued participation in any offering following such updates constitutes acceptance of the revised terms.
17. Governing Law & Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of the State of Louisiana, U.S.A. Any disputes arising under this Agreement shall be resolved exclusively in Livingston Parish, Louisiana. The parties agree to attempt good-faith resolution before initiating formal proceedings.
